Terms and Conditions - Livestream

"OPPO Easter Livestream Giveaway" (the "Promotion") is organized and promoted by Guangdong OPPO Mobile Telecommunications Corp, Ltd (the "Promoter" or "OPPO") and is subject to the following terms and conditions.
To participate in the Promotion, follow the instructions on this website and accept the following terms and conditions, which will form a binding agreement between you (or the "Participant") and OPPO.

1.1. By participating in the Promotion, you hereby accept these participation rules (referred to hereafter as "the Rules"). If you do not wish to accept these rules, please do not enter.

1.2. The Participant must be a follower of the Promoter's official account (@OPPO for Instagram).

1.3. Participants must join the giveaway by viewing and commenting on the livestream with correct answer on Instagram. OPPO will select winners at random from participants who answer/guess correctly on the livestream.

1.4. To qualify for participation in the promotion, you must be over 18 years of age. If under 18 years of age, you must first obtain permission from your parent or legal guardian.

2.1. The Promotion will begin at 17:00 (UTC+08) on March 29th, 2024 until the livestream ceases transmission.

2.2. Each Participant can only win a maximum of one prize for the giveaway.

2.3. Entry to this Promotion is free of charge and is open to all countries except for those in Europe (for applicable regulations limits, participants with Europe-based IP addresses will be considered as ineligible entries). You understand and agree that not all the giveaways can be delivered successfully due to the requirement of applicable laws or logistics problems in your country or region. In such an event, OPPO shall have the right to suspend such giveaways without any legal liabilities.

2.4. The Promoter is not responsible for entries to the Promotion that cannot be processed due to any technical or operational reasons. Entries that are lost, late, misdirected, incorrect, incomplete, for any reason whatsoever, will not be eligible.

2.5. The Promotion details form part of these terms and conditions.

2.6. Use of a false name or address will result in disqualification.

3.1. A total of five prizes will be awarded for this promotion on Instagram, with one device per winner. The specific devices will remain undisclosed until the winners are announced.

3.2. In cases where a prize cannot be delivered due to causes originating with the winner (including but not limited to failure to provide contact information within 48 hours of the conclusion of the event or submission of incomplete or inaccurate contact information that prevents the Promoter from establishing contact) the prize will automatically be considered waived. The Promoter assumes no responsibility for any such outcome and will not reissue the prize in such cases. Upon receiving their prizes, winners will be expected to confirm completion of delivery by notifying the distributor directly, except where abnormal circumstances prevent this. OPPO shall not be liable for any accidents or damages suffered by winners relating to the use or receipt of prizes.

3.3. Prizes may not be exchanged for cash. If unforeseen circumstances prevent the distribution of a prize, the Promoter reserves the right to issue an equivalent prize in its place. Replacement awards may not be exchanged for cash.

3.4. Prize recipients shall bear full responsibility for any personal income taxes incurred with their prizes. The Promoter shall bear full responsibility for any domestic or international shipping charges incurred by the delivery of the prize.

3.5. Once prizes have left the Promoter's premises, the Promoter takes no responsibility for prizes damaged, delayed, or lost in transit.

4.1. The Promotion is open for participation from 17:00 (UTC+08) on March 29th, 2024 until the livestream ceases transmission.

4.2. The winners of the giveaway will be announced and will receive a notification message from the Promoter on March 29th, 2024. The winners may provide their email addresses for further contact about prize delivery.

4.3. Winners must then provide their full legal name, nominated prize delivery address, and contact phone number via email to the Promoter within 48 hours. If the winner fails to do so or is unable to comply with these terms and conditions, the Promoter reserves the right to offer the prize to another winner selected by the Promoter.

4.4. Upon receipt of the Winner's full legal name, nominated prize delivery address, and contact phone number via private message, the use of a false name or contact information will result in disqualification.

4.5. If the winner(s) fails to redeem his/her prize, this will be deemed as a waiver of said prize. OPPO will not be held responsible for rescheduling, replacement, or other liabilities.

5.1. This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram. Entrants understand that they are providing their information to the Promoter and not to Instagram. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments, or complaints about this promotion must be directed to the Promoter and not to Instagram, or X/Twitter.

6.1. OPPO reserves the right to make reasonable adjustments to the above terms and conditions in keeping with standard practices for similar events and transfer of public gallery rights. Please refer to these terms regularly to ensure you are aware of and understand any changes made by OPPO. By continuing to use this site, you accept these terms and conditions as legally binding regardless of any changes occurring herein.

6.2. The Promoter reserves the right to disqualify any Participant from the Promotion if, in the Promoter's sole discretion, it reasonably believes that the Participant has attempted to undermine the legitimate operation of the Promotion by cheating, deception or other unfair playing practices or annoys, abuses, threatens or harasses any other Participants or the Promoter. The Promoter reserves the right in its sole discretion to revoke any Prizes awarded, at any time.

6.3. The Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion without any liability whatsoever.

6.4. The Terms are governed by the laws and regulations of the People's Republic of China and the courts of the People's Republic of China shall have sole jurisdiction.

6.5. None of the above paragraphs limits any other.

7.1. To participate in the promotion, you understand that your Instagram username and comments may be disclosed to other participants. If you are not willing to disclose such information, please do not participate in the Promotion.

7.2 If you win the prizes, the Promoter will collect your email address, full legal name, nominated prize delivery address, and contact phone number to deliver the prize. After the delivery is completed, the Promoter will delete the afore-mentioned personal information. The Promoter will not share, or otherwise disclose the personal information of winners to third parties, other than to third parties engaged by the Promoter to fulfill the above purposes.
