Terms and Conditions

“EnjoyThePresent” Game (the “Promotion”) is organized and promoted by PT. World Innovative Telecommunication (the “Promoter” or “OPPO Indonesia”) and is subject to the following terms and conditions. To participate in the Promotion, follow the instructions on this page and accept the following terms and conditions, which will form a binding agreement between you (the “Participant”) and OPPO Indonesia.

1.1. By participating in the Promotion, you hereby accept these participation rules (referred to hereafter as "the Rules"). If you do not wish to accept these Rules, please do not enter.

1.2. The Participant must be a registered member of Facebook or Instagram and should be a follower of the OPPO Indonesia Official Facebook page (@OPPOIndonesia).

1.3. The Participant must join the giveaway by following OPPO Indonesia Official Facebook page.

1.4. To qualify for participation in the promotion, you must be over 18 years of age. If under 18 years of age, you must first obtain permission from a parent or legal guardian.

2.1. To participate in the Promotion, you must be a follower of OPPO Indonesia Official Facebook page (@OPPOIndonesia).

2.2. This giveaway starts at 9:00 (GMT+7) on December 12th, 2023, and will end at 23:59 (GMT+7 ) on December 31st, 2023.

2.3. Each Participant can only win a maximum of one prize for the giveaway.

2.4. Entry to this promotion is free of charge and is open to all Indonesian or permanent residents of Indonesia. You understand and agree that not all the giveaways can be delivered successfully due to the requirement of applicable laws or logistics problems in your region. In such an event, OPPO Indonesia shall have the right to suspend such giveaways without any legal liabilities.

2.5. The Promoter is not responsible for entries to the promotion that cannot be processed due to any technical or operational reasons. Entries that are lost, late, misdirected, incorrect, incomplete, for any reason whatsoever, will not be eligible.

2.6. The Promotion details form part of these terms and conditions.

2.7. Use of a false name or address will result in disqualification.

3.1. Eligible Participants with valid email address will get a code. When put into OPPO.com, it will generate Rp. 100,000 DISCOUNT for OPPO Products, EXCEPT: OPPO A18, OPPO A38, OPPO A58 series, OPPO A78 series, OPPO A98 5G, OPPO Reno10 Series, OPPO Find N2 Flip, OPPO Find N3 series, HD Screen Protector A58, A78, A98 5G, A17k, accessories Reno10 Series, accessories Find N2 Flip, accessories Find N3 series, accessories Pad Air OR accessories Pad 2 (with minimum purchase of Rp 1,000,000). The code is valid until January 31st, 2024. To get the code, Participant must enter their email address in the box that appears after the game.

3.2. In cases where a prize cannot be delivered due to causes originating with the winner (including but not limited to failure to provide contact information within 48 hours of the conclusion of the event or submission of incomplete or inaccurate contact information that prevents the organizer from establishing contact) the prize will automatically be considered waived. The Promoter assumes no responsibility for any such outcome and will not reissue the prize in such cases. Upon receiving their prize, the winner will be expected to confirm completion of delivery by notifying the distributor directly, except where abnormal circumstances prevent this. OPPO Indonesia shall not be liable for any accidents or damages suffered by the winner relating to the use or receipt of prizes.

3.3. Prizes may not be exchanged for cash. If unforeseen circumstances prevent the distribution of a prize, the organizer reserves the right to issue an equivalent prize in its place. Replacement awards may not be exchanged for cash.

3.4. Prize recipients shall bear full responsibility for any personal income taxes incurred with their prizes. The Promoter shall bear full responsibility for any domestic or international shipping charges incurred by the delivery of the prize.

3.5. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed, or lost in transit.

4.1. The giveaway is open for participation from 09:00 (GMT+7) on December 12th, 2023, and the Participant should respond to the activity rule before 23:59 (GMT+7 ) on December 31st, 2023.

4.2. The winners of the giveaway will not be announced but will receive a notification message from the Promoter at the latest, January 15th, 2024.

4.3. At the end of the game, Participant must provide their valid email address at game page. If Participant fails to do so or is unable to comply with these terms and conditions, the Promoter reserves the right to offer the prize to another winner selected by the Promoter.

4.4. Use of a false name or contact information will result in disqualification.

4.5. If the winner(s) fails to redeem his/her prize, this will be deemed a waiver of prizes. OPPO Indonesia will not be held responsible for rescheduling, replacement, or other liabilities.

5.1. This promotion is in no way sponsored, endorsed/administered by, or associated with Facebook or Instagram. Entrants understand that they are providing their information to the Promoter and not to Facebook or Instagram. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments, or complaints about this promotion must be directed to the Promoter and not to Facebook or Instagram.

6.1. OPPO Indonesia reserves the right to make reasonable adjustments to the above terms and conditions in keeping with standard practices for similar events and transfer of public gallery rights. Please refer to these terms regularly to ensure you are aware of and understand any changes made by OPPO Indonesia. By continuing to use this site, you accept these terms and conditions as legally binding regardless of any changes occurring herein.

7.1. Personal information collected from each winner will be used by the Promoter for the purpose of delivering their prize. After the delivery is completed, the Promoter will delete all the personal information. The Promoter will not sell, share, or otherwise disclose the personal information of winners with third parties, other than to third parties engaged by the Promoter to fulfill the above purposes.

7.2 By entering the Promotion, you are expressly consenting to the processing of your personal information by Promoter for the purpose of the Promotion or any associated publicity by Promoter or its affiliates.

a. Promoter may share with partners and authorized licensees for Promotion administration and prize fulfilment purposes.

b. You consent to your personal data being transferred, stored (both electronically and manually) by Promoter to Promoter and its business partner(s) located outside of Indonesia for the purposes of maintaining records of the Promotion and developing Promotion-related external marketing materials (“Materials”).

c. You acknowledge that collection and processing of the personal data for the uses described herein shall constitute a legitimate business need of the Promoter.

d. Promoter undertakes to ensure that it and its partners will take appropriate measures to protect your personal data and use your personal data only for the purposes described in this Terms and Conditions. Both Data Controller(s) and Data Processor(s) shall sign data processing agreements (DPAs) to meet the requirements of applicable laws with respect to data processing.

e. For more information on how we retain, share, transfer, and disclose your personal information, the measures we will take to protect your personal information, your rights as a data subject to your personal information, etc., please refer to our Privacy Policy .

8.1 You agree:

a. To be bound by the Terms and Conditions and all decisions of the judges, which are final and binding.

b. This Terms and Conditions shall be governed and construed in accordance with applicable laws and regulations of The Republic of Indonesia without regarding to conflict laws thereof.

c. The Parties agree to exclusively submit the disputes to The Republic of Indonesia law subject to the arbitration rules in force. The seat of arbitration shall be The Republic of Indonesia. The language of arbitration shall be English. The arbitration award is final and binding on the Parties. That they consent and waive any objection to the jurisdiction of said tribunals for any such disputes.

d. Promoter reserves the right of interpretation with respect to the Terms and Conditions. Should there exist any conflict between the Terms and Conditions and any other communication, the T&C shall prevail.

9.1 Each Participant agrees to keep in strict confidence any Promoter confidential information they may encounter during the course of their participation of the Promotion. “Confidential Information” includes, but is not limited to names and Personal Data of Promoter employees and agents, names and Personal Data of other Participants; information about current, future and potential products; financial information; unreleased marketing campaigns; business methods; information marked as “Confidential”; and any other information reasonably expected to be kept confidential under the circumstances. Participants shall not disclose, disseminate, transfer, copy, exploit, or otherwise make use of such Confidential Information without Promoter’s express written consent. Exception may be made for Confidential Information that becomes available through no fault of the Participant or is disclosed pursuant to an order from a court or other government body of competent jurisdiction, provided that the Participant notifies Promoter in advance and takes reasonable steps to limit any further disclosure.
